DMCA Notice Information

As an online service provider, Portal Labs, LLC, the parent company and operator of Digital Product Delivery (DPD) at has filed a Service Provider Designation of Agent to Receive Notification of Claims of Infringement with the U.S. Copyright Office.  Our registration information at the US Copyright office can be found online here.

Under the The Digital Millennium Copyright ACT (DMCA), copyright holders and their agents can demand removal of allegedly infringing content. To do that, they must provide a complete takedown notice. Under the law, this notice must contain the following elements:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

This notice, which must be filed by the copyright holder or an authorized agent of the copyright holder, may be sent to the following:

Portal Labs, LLC will accept physically signed and then scanned (attached as a PDF, etc.) or digitally signed documents via email that satisfy the legal requirements of the DMCA as outlined above.

Upon receipt of a DMCA takedown notice Portal Labs, LLC will review the notice to insure it includes all information required by law and take action to remove infringing content for sale on DPD within 72 hours.

Portal Labs, LLC will then contact the vendor to provide them with the opportunity to respond and/or file a Counter-Notice as outlined by the provisions of the DMCA.
